AUCTION SALES

AUGUSTA LAND FOR SALE.--In Pursuance of the last Will of Christian Rusmisel, dec'd., we will sell, to the highest bidder, on Wednesday the 6th of February, 1861, if fair, if not, the next fair day, the LAND on which the said Rusmisel lived and died. This land lies one mile west of Mt. Solon, and adjoins the land of Philips Dinkle, Skyles and others, and is supposed to contain some 160 or 170 Acres. This land is of good quality. There are some 90 acres cleared, of which there are about 85 acres of BOTTOM LAND, clear of rock and easy to cultivate; the balance is finely timbered and of good clay soil.--It is situated in a fine neighborhood and is convenient to Stores, Schools, Mills, Post Office, &c. The improvements consist of a good LOG DWELLING, Kitchen, Stone Dairy, a Well of good water in the yard, Barn, Corn House, and a fine ORCHARD of Apple Trees. Any person wishing to purchase this farm can see it by calling on John J. Rusmisel, who resides upon the premises, and he will take pleasure in showing it.

TERMS.--One-third of the purchase money cash, or negotiable paper at 60 days, interest added, payable at either of the banks in the town of Staunton; the balance in three equal annual instalments, bearing date from date of sale--purchaser to give bond with approved security for the deferred payments, and the legal title to be retained as additional security until the whole purchase money is paid.

Also, on the same day, we shall offer a lot of Household and Kitchen Furniture for sale as follows: Bedsteads and Bedding, Chairs, Tables, Carpeting, 1 fine eight-day Clock, 1 Cupboard, 1 Cook Stove, and various other articles not mentioned.

TERMS--On Personal Property, 6 months credit on all sums of five dollars and upwards; under that the cash will be required.

According to his daughter Letha, Jesse had stayed at home to look after his parents. Hettie was a "nurse."  Letha (Rusmisel) McVeigh said that when he and Hettie were married he was a caretaker at a hunting club named the Pimrod Inn [sic--should be Nimrod Hall] on the Cow Pasture River and she was a nurse at a hospital in Staunton. A Rusmisel Cousin, Rick Armstrong, who has done a lot of research, found a reference to him being there in Sep 1905.  [Rick says, "The place is Nimrod Hall. In the early part of the 1900's the place was a hotel and later a summer camp for children. The old buildings are still there and seem to be in fairly good repair."- Dec. 3, 2002]

They moved to Clifton Forge around that time since Chertsey was supposedly born there 12 April 1905.  After the death of her husband, Jesse's mother Elizabeth E. Rusmisel remained on the farm. At some point, she deeded her property to her son, J. B. Rusmisel, with the understanding that he would pay her burial expenses and other debts. She later became dissatisfied, and asked for the property to be returned. J. B. Rusmisel had not recorded the deed and complied with her wish. He stated in September 1905 that his brother Harrison Rusmisel had gotten her dissatisfied and convinced her to give the property to his wife, Mary C. Rusmisel. Maybe his mother didn't like him marrying Hettie.
According to daughter Letha, between 1903 and 1905 they moved to Clifton Forge. Jesse was working as a railroad mechanic in shop repairs. Chertsey Brooks Rusmisel was born Apr 12, 1905 when they were living on Church Street and was named after a nurse who worked with Hettie. About 1907 John Rusmisel was born, but he only lived a few hours. On Feb 19, 1909 Maude Moore Rusmisel was born on Hospital Hill and was named by Hettie's father John Jordan. All of the children were baptized in the Presbyterian Church in Clifton Forge. Jesse was Lutheran until his marriage, but Hettie was Presbyterian, so they went to the Presbyterian Church. Hettie became ill with "TB or Black Lung." The children stayed a while in Millboro with their grandparents Jordan for a while, then later Hettie put them in the Presbyterian Orphanage in Lynchburg. Hettie died in Clifton Forge and was buried in Staunton.

In Clifton Forge, Jesse may have worked in the coal mines according to Letha. He was also a mechanic in shop repairs and "car repair" on the railroad (1910 Census). Hettie's death certificate (1913) says he was a "House mftr, contractor and carpenter." Hettie's death certificate says she died of tuberculosis.

After Hettie's death the girls were in the Orphanage in Lynchburg, VA and Jesse went to Charleston to work in the shipyards. Letha said it was cold and awful like in the book Jane Eyre [but other sources say it is actually quite nice--it is still there]. She said they had single beds but would sleep together to keep warm. They were there for about 6 years, when Letha was about 11 to 16.


Letha left the orphanage first about 1919 and went to Charleston. There she worked as a messenger and then as a file clerk. Maude and Chertsey went to Ohio to stay with Hettie's sister Carrie Jordan, who had married Joe Pearce. Chertsey met Floyd Carswell  and they were married. Maude came to Charleston.

Letha said that during World War I the spelling of the name was changed to make it less German sounding--from Rusmisel to Rusmiselle. They told people it was a French name.
Letha met Norman McVeigh in Charleston, SC, when he was stationed there during World War I. They met while dancing. He had been dating Chertsey and Letha was dating a doctor. Chertsey had a temper and the doctor was too jealous. Letha was working at the Ferscott Store, a ready-to-wear. John, Henry, and Norman McVeigh were all in the Navy together. Their sister Ora had come to Charleston to visit so Letha had also met her. Letha and Norman went for a vacation to Waynesville, GA to meet the rest of the McVeighs. Letha was 18. They were married at First Methodist Church in Brunswick, July 23, 1921.

About 1920 (after the Census on Jan. 22) Jesse married a widow, Jeanne Drucilla "Jennie"  (Oxner) Harmon, who had a child named Mary Ellaphine Harmon. 
After the war Jesse went to live in Ohio near his daughter Chertsey where he worked as a contractor and a carpenter. He also worked as a contractor in SC and GA. He came to stay with Norman and Letha McVeigh in Waynesville because he couldn't get work. Jennie and Elophine came, too. They also stayed in Charleston and Lexington, SC, where Ginnie's folks lived. Jesse and Norman McVeigh built the first McVeigh store in Waynesville.

Jesse died 30 Jan. 1942 in Waynesville in an accident with a gun.  He is buried at Highsmith Cemetery in Waynesville. Jeanne Oxner Rusmisel  died 8 Jan. 1985 in a Claxton, GA nursing home. She is buried in St. John's Lutheran Church Cemetery in Lexington, SC.

Obituaries of Catherine Evaline (RUSMISEL) STAUBUS

Two Obituaries taken from unknown [Illinois] newspapers, unknown dates, concerning the fatal accidental buggy death of Catherine (Catharine) Evaline (RUSMISEL) STAUBUS 0n 29 June 1900 near Danvers, McLean County, Illinois.

A Fatal Runaway--

Last Friday morning about eleven o'clock a runaway accident occured at the home of Mr. Samuel Elkins, three miles southeast of Danvers, which a few hours later resulted in the death of Mrs. Solomon Staubus. The deceased in company with her husband were about to pay a visit to the home of their son-in-law, Mr. Samuel Elkins, and upon arriving at the gate of the latters farm, Mr. Staubus opened the gate. While Mrs. Staubus was driving through the gate, her umbrella dropped. The horse became frightened and started to run at full speed. After running for some distance, Mrs. Staubus was thrown against a fence with terrific force, so much so that one side of her face was torn off, one arm dislocated besides being injured internally. Dr. F. J. Parkhurst was hailed and did everything possible for her relief. She regained consciousness for a time, but shortly after six o'clock the same afternoon she passed away. The deceased was born in Virginia June 23, 1837. She was married to Mr. Solomon Staubus, who survives her. The children still living are Mr. Newton D. Staubus, of LeRoy; Mrs. S. A. Munsell and Mrs. Emory Perry, of Twin Grove; Mrs. Fanny Kent, of Bloomington; Mr. Samuel Staubus, Mrs. J. H. Stephenson, and Mrs. Samuel Elkins of Danvers. the funeral services were held on Sunday afternoon at the Presbyterian church of which she was an honored member. The services were in charge of the pastor, Rev. C. E. Hayes. The music for the sad occasion was rendered by Mrs. W. H. Ayers, Mrs. C. E. Hayes, Mr. Chas. Buhlm and Mr. C. R. Stuckey. The floral offerings from friends were both beautiful and profuse. The church was crowded and many were unable to find seats. It was the largest funeral that has occured in Danvers for many years. The remains were laid away to rest at the Park Lawn Cemetery.

A Fatal Accident

There was a fatal accident last Friday afternoon at Danvers which resulted in the death of  Mrs. Solomon Staubus, wife of a well known farmer living 3 1/2 [miles] southeast of that place. She was accompanying her husband on a visit to her son-in-law, Mr. Samuel Elkins. When they arrived at the gate of the latter's farm, Mr. Staubus alighted from the buggy and Mrs. Staubus drove through. While she was doing this, her umbrella dropped, frightening the horses. They ran into a fence and Mrs. Staubus was thrown to the ground with great force. She was badly injured about the head and it was known that she could not survive. The fall rendered her unconscious and that evening, after great suffering, she passed away. The community was greatly shocked by the news of her tragic death.
The funeral services were held Sunday at 2:30 p.m., at the C.P. church at Danvers, and the sad and tragic circumstances of her death tended to mjake it deeply impressive, tender and solemn. The church was filled to its utmost capacity and many could not even get standing room. The floral tributes were numerous and covered the casket and the adjacent stands. The services were conduced by the pastor, Rev. C. E. Hayes, who read the funeral lessons.
Mrs. Catherine E Staubus was born in Augusta county, Virginia, June 28, 1837. She was married to Solomon Staubus in the city of Baltimore, December 26, 1854, and came to Illinois in 1856, settling in Dry Grove township, where they lived all these years. To them nine children were born, seven of whom survive. They are: N. D. Staubus, of LeRoy, Mrs. E. A. Kent and Mrs. Maggie Perry, of Bloomington, Mrs. Gussie Munsell, Mrs. Anna Stephenson, Mrs. Lookie Elkins and Samuel C. Staubus of Danvers. The two that preceded the mother into the better world were Mrs. Mattie Stephenson and Minnie S., who died in infancy. Mrs. Staubus professed religion in 1861, when she and her husband united with the C. P. church, in which communion she lived a consistent member until her death.

Martha  A McMULLEN [McMULLEN]  was the daughter of James and Mary (HENDERSON) McMULLEN. She was born 11 Feb 1805 in Augusta County, VA and died 29 Jun 1887 near Mount Solon, Augusta County, VA. She married (1) James W. TAYLOR , 7 Jan 1874 in Augusta County, VA  and was widowed when he died in Ohio in 1827. She married (2) Christian RUSMISEL 6 Oct 1831 in Augusta County, VA.

Obituary of Johann Christian Rusmisel, born 14 Feb 1787 Tulpehocken Township, Berks County, PA, died 7 Sep 1860 near Mount Solon, Bath County, VA. He was the son of Adam and Rachel (Schumacher) Rusmisel.

Transcription:
September 14, 1860 issue of the Staunton Vindicator: Near Mt. Solon, on the 7th inst., Christian Rusmisel, in the 74th year of his age. In the death of Mr. Rusmisel, Augusta County has lost another of her aged and valued citizens. He was born in the county, and never had even a temporary residence out of it. He was a good man in all the relations of life - affectionate and devoted as a husband and father - warm as a friend and neighbor; he was also a christian. Since early life he had been a consistent member of the German Reformed church. He died in the full hope of a glorious resurrection. P.

Note errors: (1) He was born in Pennsylvania and 2) he was a soldier in the War of 1812, and most likely went outside the county then.

Frederick CUPP (1784-1867)

Frederick CUPP was born 17 Mar 1784 in Augusta County, Virginia. He died 14 Jan 1867 in Augusta ?County. I do not have proof of these dates and places, but they are on many family trees. He married Elizabeth BAKER 21 Aug 1810 in Rockingham County, Virginia. His father is said to be Marcus CUPP.

I am interested in Frederick because two of his children married the children of Christain RUSMISEL:

There is a Frederick CUPP on the 1840 Census in Rockingham, but he is too young to be this Frederick. He may be a son or a nephew. This Frederick is probably there under one of the many variant spellings:

Lawsuits concerning Christian RUSMISEL's Will

Christian RUSMISEL (son of Adam) died 7 Sep 1860 near Mt. Solon in Augusta County, VA. His will was proved 22 Oct 1860. Settlement of his estate did not take place until after the Civil War, so the estate suffered. His son, George, and son-in-law, Asher ARGENBRIGHT, were executors. The lawsuit was abstracted by Richard ARMSTRONG.

1864, Oct.: After the War Between The States, a suit was filed by Rachel M. Rusmisel Powers, alleging that she was compelled to accept Confederate notes for her portion of Christian's estate. This money, she said, was worth four cents on the dollar. The complaint by Rachel, states that in October 1864, as well as she can remember, Asher Argenbright came to the home of David Propst, her brother-in-law, where she was then staying. He brought to her a sum of money, in Confederate notes, which was her inheritance. She stated she refused to accept the money, and that Argenbright said he would compell her to accept the money, that she was legally bound to accept it. The complaint reads: "Deceived by these statements, she, being an uneducated female & ignorant of law & of all kinds of business, was finally persuaded, in the absence of her friend, to sign a paper acknowledging the receipt of the so called money.

A complaint [against George Rusmisel and Asher Argenbright as executors of Christain Rusmisel's will] , brought by John I. Rusmisel, and his sisters, Martha M., Marian E., Mary Cupp, Catharine Staubus, Rachel Powers, Rebecca Propst, and Pricilla Staubus, state: At the time of Christian Rusmisel's death, he owned a tract of land containing 170 3/4 acres, valued at at minimum of $35 per acre (worth $5,976.25). His personal property was offered for sale on February 7, 1861, and due to the uncertain times, the land was not sold. The land was held by the executors until February 1863, when it was sold to Jonas Lowman in aprivate sale. This was a violation of the will of Christian Rusmisel, who asked that it be sold at public auction. At the time of the sale, the executors received $3,000.00 in Confederate notes, with the balance to be paid in two installments; one on March 15, 1864 ($1,915.00) and the final one on March 15, 1865 ($1,915.00). At the time of the sale (February 1863), the Confederate notes were worth 20 to 25 cents on the dollar ($600 - $750). At the time the second payment was made, the notes were worth only about 4 cents on the dollar ($76.60). The third and final payment was never made. It was further stated: "That at the date of this sale your orator John I. Rusmisel was a prisoner of war at Fort Delaware, your orators Solomon Staubus and wife were living in the State of Indiana and your oratorex Martha M. Rusmisel was an infant, none of whom knew of the sale of the land, or have very received one cent of the purchase money from the

Executors. The rest of your orators, trusting the matter to the Exs. receipted to them for small sums of Confederate money as it was offered to them, not knowing or examining into their rights..." John and his siblings asked that the sale be set aside and the land be sold at public auction.

1871: Rebecca V. Propes, wife of David Propes, made a deposition, in which she states she has read the deposition of Rachel M. Powers regarding the $500 paid to her by Asher Argenbright..."I was present at the time of that transaction, which occurred at my own house -Rachael was then staying with me, and her memory is wholy at fault as to what really occurred - the true facts are these - Mr. Argenbright brought her five hundred dollars in confederate money. She made no objection whatever to receiving it - she receipted to him for the above amount, taking one Hundred thereof for her present individual use and advised with him as to what she ought to do with the remaining four hundred." Mr. Argenbright was going to Harrisonburg to invest some money in a Confederate bond. "She then requested him to take her four hundred & do likewise with hers. Mr. Argenbright on that occasion so far from using any threats to compel Rachael to receive the Five Hundred dollars, did not even try to pursuade her in fact there was no occasion for him to do so, because Rachael expressed no hesitation in giving him the receipt for the five hundred dollars, directing him to invest the four hundred above stated in a Confederate bond for her use in her own name. She said nothing whatever at the time about Confederate money not being good, and the whole transaction between both parties at the time was fair honest and voluntary. My husband and myself took our portion also in Confederate money, receipting just the same as Rachael did..."

1871: George Rusmisel, in a deposition, stated that Rachael asked them (the executors) to sell the cow she was bequeathed, and that she did not express any desire to retain any of the items bequeathed her, but would rather have the money for them. They were therefore sold, and the money given her.

Tonight I decided to research David R RUSMISEL (1808-1860), son of Christian, son of Adam. I had a bit of info on him from some reliable sources, but no primary documentation. I was thrilled to find some census records, including his death on the Mortality Schedules. The 1850 Census says he was a Tanner. The mortality schedules say he died in an accident. There is a one month old baby girl on the 1850 Census who has not been named yet. She was born in Illinois. The next child, Martha P., was born in Virginia two years before. All the other children were also born in Virginia.
